Copyright *

All photographs taken by photographer are her property, will remain her property and are protected by United States Copyright Laws (USC Title 17). If high resolution digital files are purchased, a print release will be supplied with those files. The release grants Client the right to reproduce the images provided for their personal use.

Reschedule *

Should you need to reschedule your session, you must contact Scarlett Rose Photography before your scheduled session otherwise you will be considered a no show and all monies paid will be kept by the photographer for her time.. You will be able to reschedule (max 2 times) without paying a new retainer.

For Sessions booked in Airbnbs or Hotels: If you are not able to attend your session, and if your session is paid in full AND you contact Scarlett Rose Photography before your scheduled session, you may, within 90 days of your session date, schedule a WEEKDAY MINI session to be held in the studio. Should you wish to upgrade this session, you will be credited the cost of a WEEKDAY mini session or the amount paid (whichever the lesser amount is) towards a FULL boudoir session. If you do not contact Photographer prior to your session you will be considered a no-show and will forfeit all money paid. If you do not pay off the payment plan/session by the original scheduled date you will forfeit all money paid. If the mini session is not scheduled within 90 days of the original date, you will forfeit all money paid. Credit can not be applied to a session already scheduled.

If you are scheduled for an outdoor session and we have to reschedule due to weather you will have the option of doing your session in the studio or rescheduling to the next available date.,

Please note if you had a discount your discount may not be transferred to your new date and you may have to pay the difference in price. Rescheduling gives you a credit towards a new boudoir session only. So if there has been a price change you would be responsible to pay the difference in price. Late fees are not credit., If the photographer has to reschedule the session for any reason this is not counted as your two times nor would you lose your discount if you had one.

Pricing *

Services or merchandise not included in this initial contract will be sold at current price when an order is placed. All prices are subject to change at any time without notice. Credit vouchers have no intrinsic cash value and may only be applied toward merchandise purchased from Photographer. All print/album credits and sessions must be used within 6 months of web gallery posting.

Scarlett Rose Photography is not liable for any injuries, illnesses or allergies that may occur during your session. Please use caution at all times.

Cancelations *

If for any reason Client cancels this contract before the scheduled date, Photographer will keep all monies paid as the retainer. Retainers/Payments cannot be transferred to a new booking unless payment plan/invoices are completely then they may be able to be rescheduled, see options for rescheduling. Boudoir payments can only be used for Boudoir sessions.

Retainer and Payment *

Client shall reserve the time and date of services by signing and returning this contract along with a non-refundable, non-transferable reservation retainer. No date is reserved until the contract and retainer are received. The balance due for the photography services must be paid a week before the session by invoice or by cash or card. If paying by cash please make sure you have the correct amount. If session balance isn’t paid off prior to the session, session will need to be rescheduled. Checks are not accepted.

Payment Option For Boudoir - All payments made are NON REFUNDABLE. They can be rescheduled providing that your payment plan and session are not canceled for NON PAYMENT. *

PAYMENT PLAN - Session total is broken up into weekly, bi weekly or monthly payments. Invoices come out automatically. Invoices are due within 5 days. Unpaid invoices will have a late fee added at day 15. Late fees cannot be removed. They are FEE Free and INTEREST Free providing they are paid on time. Payment plans must be paid off prior to your session. Rescheduling your session does not alter the payment plan. You will need to complete the PAYMENT PLAN AGREEMENT on your invoice to do a payment plan

TWO PAYMENT OPTION - Half is due when booking and balance is due one week before the session.

AFTERPAY - Is a third party option. That you will have to apply for. First payment must be paid when booking. This is the only option that you can do your session and be still making payments.

PAY IN FULL - You are able to pay in full when booking.,

Coverage *

Photographer will provide coverage for the dates, locations and continuous hours specified in this Agreement. Additional travel or coverage hours may be added by agreement on the day if available and must be paid in full before any photos or products are released to the Client. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organizational purposes only. Images determined by the photographer to be substandard or duplicated may be edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Under no circumstances will Scarlett Rose release the raw images.

The customer wardrobe is available for FREE of charge with sessions in the Studio. Some bonus rooms and sessions out of the studio require you to bring your own outfits. *

Age Requirements *

You must be 18 years or older to do boudoir. 21 years or older to use bondage props in your session. Please take a photo of your current ID and forward to Scarlett Rose Photography prior to your session to keep on file either via messenger, text 513-327-8480 or email scarlettrosephotographyohio.net. If you are using bondage props in your session you will also need to go onto the website www.scarlettrosephotography.net and under the boudoir section is form 2257. You will not be able to use bondage props if this form is not completed.

Digital Images/USB's *

Upon receipt of a photo USB or Digital Images, Client accepts all responsibility for archiving and protecting the photographs. Photographer does not permanently archive image files. Photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read discs provided. It is Client's responsibility to make sure that digital files are copied to new media as required.

Illness/Pandemic *

If any member of the family has had a fever or flu like symptom in the 48 hours before your session please reschedule. If the photographer or photographers family has a fever or flu like symptoms you will be contacted to reschedule your session. If the studio is forced by the state or federal government to close due to a pandemic your session will be rescheduled to another date once the studio is able to reopen.

Image Processing/Printing *

Unless agreed upon prior to any editing work, high-resolution discs and/or proof sets may contain a mixture of color, black and white, Limited color correction and/or retouching are included at Photographer's discretion. Client may request further changes for an additional charge. Photographer is not responsible for any prints that are not ordered directly from her. For best results, clients with the high-resolution files should order their prints through a reputable lab. You can request a sneak peek via our facebook page during the editing time. Expected editing time from the date of session is approximately 3-8 weeks. I do advise that sessions are scheduled 8 weeks prior to you needing the photos to allow for editing, prints and album production times. During peak season this could change. Scarlett Rose Photography does offer a RUSH Service. This cannot be put into a payment plan. See price list for further details. All products are to be picked up from the studio during business hours or you can request drop ship for an additional fee.
